การที่ประชาชนจะพูด จะวิพากษ์วิจารณ์สถาบันพระมหากษัตริย์ ทำไมถึงต้องผิดกฎหมายอาญามาตรา ๑๑๒ ด้วย เช่นนี้ คือความเป็นธรรมที่มีให้แก่ประชาชนงั้นหรือ ?
ตอบ:
การพูด การวิพากษ์วิจารณ์โดยสุจริต ด้วยจิตที่หวังดี ไม่มีอะไรผิด แต่มันจะผิดเอามากๆ หากวิพากษ์วิจารณ์ด้วยอารมณ์ ความรู้สึกที่จงเกลียดจงชัง ด้วยข้อมูลอันเป็นเท็จ เพื่อมุ่งหวังเซาะแซะกัดกร่อน บ่อนทำลายให้เกิดความเกลียดชังต่อองค์พระประมุขของชาติ
ซึ่งก็ไม่มีประเทศไหนในโลก ที่เขาจะปล่อยให้ใครต่อใครมาย่ำยี ดูถูก ผู้เป็นประมุขของรัฐ ไม่เว้นแม้แต่ประเทศสหรัฐเองก็ตาม
อีกทั้งองค์พระมหากษัตริย์ก็ไม่สามารถฟ้องร้องเอาผิดต่อผู้จาบจ้วงพระองค์และพระราชวงศ์อยู่แล้ว
รัฐจึงต้องออกกฎหมาย ๑๑๒ มาคุ้มครองสถาบันพระมหากษัตริย์ เพื่อดำรงค์รักษาไว้ซึ่งความมั่นคงของสถาบันพระมหากษัตริย์ อันเป็น ๑ ใน ๓ สถาบันหลักของชาติ ที่เป็นหลักชัย หลักใจของคนในชาติ
และรัฐธรรมนูญปกครองราชอาณาจักรไทยปีพุทธศักราช ๒๕๖๐ มาตรา ๕๐ (๑) (๓) (๖) ได้กำหนดหน้าที่ของประชาชนชาวไทยเอาไว้ว่า
“ประชาชนทุกคนมีหน้าที่พิทักษ์รักษาไว้ซึ่ง ชาติ ศาสนา พระมหากษัตริย์ และการปกครองระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุข
และต้องปฏิบัติตามกฎหมายอย่างเคร่งครัด
เคารพและไม่ละเมิดสิทธิ์ และเสรีภาพของบุคคลอื่น
และไม่กระทำการใด ที่จะก่อให้เกิดการแบ่งแยกหรือเกลียดชังของสังคม”
และมาตรา ๔๙ วรรคหนึ่ง บัญญัติเอาไว้ว่า
“บุคคลจะใช้สิทธิ์และเสรีภาพเพื่อล้มล้างการปกครองในระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุขมิได้”
เวลาพวกคุณชุมนุมวิพากษ์วิจารณ์โจมตีสถาบัน พวกคุณก็มักจะอ้างสิทธิเสรีภาพตามรัฐธรรมนูญ
แล้วรัฐธรรมนูญมาตรา ๕๐ (๑) (๓) (๖) และมาตรา ๔๙ เหล่านี้ล่ะ ทำไมคุณไม่หยิบยกขึ้นมากล่าวกันบ้าง
ในประเทศนี้มีเรื่องที่พวกคุณจะพูดมากมายก่ายกอง ไม่ว่าจะเป็นเรื่องปากเรื่องท้อง เรื่องความเดือดร้อนของประชาชน ทั้งน้ำท่วม โรคระบาด ข้าวเปลือกราคาถูก และอีกสารพัดเรื่อง ที่ชาวบ้านเขาอยากให้พวกคุณพูด
แต่พวกคุณกลับเลือกที่จะพูดถึงสถาบันพระมหากษัตริย์ พูดถึงการล้มเลิกมาตรา ๑๑๒
ซึ่งว่ากันโดยเนื้อแท้แล้ว มันไม่ได้เกี่ยวอะไรกับความทุกข์ เดือดร้อนของชาวบ้านเลย
มาตรา ๑๑๒ เขามีมาตั้ง ๖๐ - ๗๐ ปีแล้ว ไม่มีชาวบ้านคนไหนเขาเดือดร้อน จะมีก็แต่พวกโกรธแค้น เกลียดชังสถาบัน ที่ไม่สามารถทำอะไรกับสถาบันได้ จึงต้องหาทุกวิธีที่จะกัดกร่อน บ่อนทำลาย
จงอย่าหลงตนเองว่า ตนมีพวกมากแล้วจะทำอะไรก็ได้ ประเทศนี้ยังมีผู้คนอีกมากมาย ที่เขาพร้อมจะออกมาปกป้องสถาบันพระมหากษัตริย์
และหากพวกคุณคิดว่าจะชนะก็ลองดู

Why did people talking about or criticizing the monarchy violate Section 112 of the Criminal Code? Was this fair to the people?
Answer:
Righteous speech and criticism with good intention is nothing wrong, but it is a big mistake to emotionally criticize with hatred and fake information, and aim to undermine and cause hatred towards the head of state.
No country in this world allows anybody to defame and insult their head of state, including the United States.
In addition, the King may not file a petition against those who have defamed him and the royal family. Therefore, the state had to issue Section 112 to protect the King and preserve the security of the monarchy, one of the three major national institutes and the heart of the people.
The Constitution of the Kingdom of Thailand, B.E. 2560, Section 50 (1) (3), (6) prescribes that the Thai people have the following duties:
“(1) to protect and uphold the Nation, religions, the King and the democratic regime of government with the King as Head of State;
(3) to strictly observe the law;
(6) to respect and not to violate the rights and liberties of other persons and
not to commit any act which may cause disharmony or hatred in society”
And Section 49 of the Constitution prescribes that
“No person shall exercise the rights or liberties to overthrow the democratic regime of government with the King as Head of State.”
When you held demonstrations to criticize and attack the monarchy, you usually cited your rights according to the Constitution. Why did you not raise Section 50 (1) (3), (6), and Section 49?
There are so many issues for you to speak about, whether how people are making a living in difficulty, the suffering of people, flood, pandemic, low purchase price of paddy, and multiple issues that people want you to speak on.
But you chose to speak about the monarchy and the eradication of Section 112, which is, in essence, not related to people’s suffering.
Section 112 has existed for 60-70 years. Nobody is bothered by it, except those who have hatred against the monarchy but can do nothing to harm the monarchy. Therefore, they have looked for every means to destroy and undermine the monarchy.
Do not be mistaken that you have lots of company and can do whatever you want. There are still many people in this country who are ready to come out to protect the monarchy.
