หลังจากโพสต์เรื่องถามมา ตอบไป กรณีมีผู้ถามมาว่า ท่านเชื่อหรือไม่ว่า นายทักษิณจะกลับมายอมติดคุก
ต่อมาพุทธะอิสระให้ทนายไปค้นหาข้อมูลดูว่า มันมีอะไรที่แปลกใหม่เกิดขึ้น ในขบวนการคุมขังหรือไม่
ทำไมอยู่ดีๆ นักโทษผู้ร่ำรวย มากบารมี หนีคดีมาเป็นสิบๆ ปี ถึงได้ให้สัมภาษณ์ว่าจะยอมกลับมาติดคุก ตามคำพิพากษาของศาล
ทนายก็ไปค้นหาจนได้พบว่า ท่านรัฐมนตรีคนดีที่หนึ่งของนายทักษิณ คุณสมศักดิ์ เทพสุทิน รัฐมนตรีกระทรวงยุติธรรมได้อาศัยอำนาจรัฐมนตรีว่าการกระทรวงยุติธรรม ออกเป็นกำหนดกฎกระทรวงเรื่อง สถานที่คุมขัง พ.ศ.๒๕๖๓ ว่า
ผู้ต้องโทษสามารถที่คุมขังอยู่ในเคหะสถานหรือสถานที่อื่นใด ที่มิใช่คุก แม้แต่บ้าน ที่อยู่อาศัยก็สามารถเป็นสถานที่คุมขังได้
โดยในโพสต์ที่ผ่านมาได้นำกฎกระทรวงที่ออกโดยนายสมศักดิ์ เทพสุทิน มาลงให้อ่านกันโดยละเอียด
ต่อมาในคลับเฮาส์มีผู้นำเอากฎกระทรวงมาอ่านโดยละเอียด ในกฎกระทรวงข้อที่ ๗ (ซึ่งมีทั้งหมด ๘ ข้อ) ความว่า
สถานที่คุมขังตามข้อ ๓ (๔) ได้แก่ สถานที่คุมขังตามข้อ ๓ (๑) (๒) หรือ (๓) ที่ใช้สำหรับคุมขังนักโทษเด็ดขาดที่เหลือกำหนดโทษจำคุกไม่เกินสามปีหกเดือน หรือต้องโทษจำคุกมาแล้วไม่น้อยกว่าสองในสามของกำหนดโทษครั้งหลังสุด ในกรณีที่เหลือกำหนดโทษจำคุกเกินสามปีหกเดือน

ด้วยข้อกำหนดนี้ ท่านผู้ร่วมสนทนาจึงชี้ให้เห็นว่า ก่อนที่นายทักษิณจักไปถูกคุมขังอยู่ที่บ้าน มันจะต้องรับโทษติดคุกไม่น้อยกว่าสองในสามของโทษที่ได้รับก่อนจึงจะไปรับโทษกักบริเวณต่อที่บ้านหรือที่อื่นได้

ขนาดพรรคของนายทักษิณยังไม่ได้เป็นรัฐบาล ลิ่วล้อผู้จงรักภักดียังสามารถออกกฎกระทรวงที่ดูจะเป็นประโยชน์แก่นายทักษิณมิใช่น้อยมาได้เลย
ท่านทั้งหลายจำไม่ได้แล้วหรือตอนนายทักษิณเป็นนายก หลายคดีที่กำลังอยู่ในการพิจารณาในชั้นศาล อัยการแผ่นดินซึ่งเป็นผู้ฟ้อง กลับมาถอนฟ้องคดีเสียเอง และต่อมาอัยการผู้นั้นก็ได้มาเป็นรองหัวหน้าพรรคของนายทักษิณไงเล่า
ด้วยการผลักดันของนายทักษิณที่ช่วยเป่าคดีธรรมกายให้
และหากพรรคของนายทักษิณได้กลับมาเป็นรัฐบาล ในสมัยเลือกตั้งนี้ พวกคุณคิดหรือว่า คนอย่างนายทักษิณจะยอมติดคุกเหมือนกับสามัญชนคนทั่วๆ ไปจริง คุณเคยได้ยินคำว่า
“อดีตเป็นกระจก สะท้อนให้เห็นปัจจุบัน”
สิ่งที่นายทักษิณและพวกได้กระทำไว้แก่ประเทศนี้ เมื่อครั้งอดีต ใครๆ ในแผ่นดินนี้ก็มีสิทธิ์คิดหวาดระแวง สงสัยต่อพฤติกรรมของคนพวกนี้ได้ทั้งหมด

After posting the answer to the question of whether I believe that Mr. Thaksin is ready to serve his prison term in Thailand, I had my lawyer check whether there are any new regulations on detention
procedures.
Why this wealthy and powerful convict who has fled his sentence for over a decade suddenly gave an interview that he is ready to serve his prison term in Thailand?
The lawyer has found out that the best minister for Mr. Thaksin named Mr. Somsak Thepsutin, the Minister of Justice issued the new ministerial regulation on detention places in 2019 that prisoners may stay in other buildings, other than prisons. Even residences can be regarded as detention places. My previous article provided details of the ministerial regulation issued by Mr. Somsak Thepsutin.
The seventh clause (out of eight clauses) states that detention places according to the Clause 3(4) are detention places according to Clause 3(1),(2), or (3) that are for prisoners with imprisonment of not over three years and six months. For prisoners with years of imprisonment over three years and six months, they must have been imprisoned for not less than two-thirds of their last sentence.

Given this clause, a person who raised questions during the Clubhouse, said that before Mr. Thaksin can be detained at home or at other places, he must have already been imprisoned for at least two-thirds of his sentence.
Then, I said, “How can you be so optimistic?”
Even when Mr. Thaksin’s political parties are not the government, his loyal allies can still issue ministerial regulations that are very beneficial to Mr. Thaksin.
Can’t you remember that when Mr. Thaksin was the prime minister, several cases were being reviewed by the court, but the public prosecutor dismissed the charges? That public prosecutor later became the deputy leader of Mr. Thaksin’s political party.
This was Mr. Thaksin’s influence in the Dhamakaya Temple's case.
And if Mr. Thaksin’s political parties become the government in the next election, do you think Mr. Thaksin would be imprisoned like regular people?
You may have heard of the saying “Past is the mirror of the presence.”
Based on what Mr. Thaksin and his allies did in the past, anybody in this country may doubt their behavior.
