กรณีคดีเจ้าอาวาสวัดสระเกศราชวรมหาวิหาร อดีตกรรมการมหาเถรสมาคม อดีตประธานคณะธรรมทูตสายต่างประเทศ ได้ร่วมกับจำเลย คือ อดีต ผอ.สำนักพุทธ และพวกอีก ๔ คน ทุจริตเงินงบประมาณของสำนักงานพระพุทธศาสนาแห่งชาติ เป็นจำนวนเงิน ๖๙,๗๐๐,๐๐๐ บาท กรณีนี้ต้องแยกออกเป็น ๒ ประเด็น
ประเด็นทางข้อกฎหมาย และประเด็นทางหลักพระธรรมวินัย ขั้นแรกขอยกเอาหลักกฎหมายมาให้ท่านได้รู้ถึงข้อเท็จจริงเสียก่อนว่าศาลขั้นต้นตัดสินว่าอย่างไร

ศาลชั้นต้นตัดสินจำคุก ๒ ปี ๑๒ เดือน

ศาลชั้นต้นตัดสินจำคุก ๓ ปี ๑๘ เดือน

ศาลชั้นต้นตัดสินจำคุก ๓ ปี ๑๘ เดือน
๔. นายพัฒนา สุอำมาตย์มนตรี อดีตนักวิชาการศาสนาชำนาญการ กองส่งเสริมงานเผยแผ่พระพุทธศาสนา
ศาลชั้นต้นตัดสินจำคุก ๓ ปี ๑๘ เดือน
๕. พระพรหมสิทธิ ธงชัย สุขโข หรือนายธงชัย สุขโข อดีตพระราชาคณะเจ้าคณะรอง และอดีตเจ้าอาวาสวัดสระเกศราชวรมหาวิหาร , อดีตกรรมการมหาเถรสมาคม
ศาลชั้นต้นตัดสินจำคุก ๓๖ เดือน ปรับ ๒๗,๐๐๐ บาท แต่เนื่องจากจำเลยที่ ๕ ไม่เคยต้องโทษจำคุกมาก่อน โทษจำคุกนั้นให้รอลงอาญาไว้ ๒ ปี
ต่อมาศาลอุทธรณ์ มีคำพิพากษาแก้เป็นว่า จำเลยที่ ๒-๔ ให้เพิ่มโทษจำคุกอีกคนละ ๑ ปี ๖ เดือน รวมกับคำพิพากษาของศาลชั้นต้น
จำเลยที่ ๒-๔ จึงต้องรับโทษจำคุกคนละ ๔ ปี ๒๔ เดือน
ส่วนจำเลยที่ ๕ คือ อดีตเจ้าอาวาสวัดสระเกศราชวรมหาวิหาร ศาลอุทธรณ์มีคำพิพากษาว่าจำเลยที่ ๕ มีความผิดตามประมวลกฎหมายอาญามาตรา ๑๕๗ และมาตรา ๘๖ จึงพิพากษาจำคุก ๑ ปี ๔ เดือน ปรับ ๑๒,๐๐๐ บาท
โดยลดโทษให้หนึ่งในสี่ จึงจำคุกจำเลยที่ ๕ เป็น ๑๒ เดือน ปรับ ๙,๐๐๐ บาท
เมื่อนับรวมกับคำพิพากษา โทษของศาลชั้นต้นที่ตัดสินให้จำเลยที่ ๕ ให้จำคุก ๓๖ เดือน ปรับ ๒๗,๐๐๐ บาท แล้ว
ศาลอุทธรณ์จึงมีคำพิพากษาอดีตเจ้าอาวาสวัดสระเกศราชวรมหาวิหาร ทั้งสิ้น ๔๘ เดือน ปรับ ๓๖,๐๐๐ บาท
โทษจำคุกให้รอลงอาญาไว้สองปี
เหล่านี้คือข้อเท็จจริง ทางด้านกฎหมายอาญา ที่จำเลยทั้ง ๕ ได้รับจากผลแห่งการกระทำ
รวมความว่า ยังไม่มีศาลไหนยกฟ้องจำเลยทั้ง ๕ สักคนเลย
ประเด็นต่อไปจะนำเอาพระราชบัญญัติคณะสงฆ์ที่เกี่ยวข้องกับการบวช การสึกของภิกษุในพระพุทธศาสนามาขยายให้ท่านได้ทราบต่อไป

The case of former abbot of Saket Ratcha Wora Maha Wihan Temple, former member of the Sangha Supreme Council of Thailand, and former Chief of Overseas Dhammaduta Bhikkhus, together with former director of the National Office of Buddhism (NOB) and four other NOB officials was their embezzlement of 69.7 million baht of Buddhism study funds. This case can be divided into two issues: legal issue and issue regarding to the code of monastic discipline.
First, let me give you legal background so that you know the facts about the Civil Court’s ruling.
1. Mr. Phanom Sornsilp, former chief of National Office of Buddhism (NOB) was sentenced to two years and 12 months imprisonment.
2. Mr. Chayapol Pongsida, a former deputy chief of NOB was sentenced to three years and 18 months imprisonment.
3. Mr. Narongdej Chainet, former director of NOB’s Buddhism promotion division was sentenced to three years and 18 months imprisonment.
4. Mr. Pattana Su-ammatmontri, a former Buddhism studies specialist of NOB’s Buddhism promotion division was sentenced to three years and 18 months imprisonment.
5. Former Phra Phrom Sitthi or Mr. Thongchai Sukkho, former ecclesiastical region governor, former abbot of Saket Ratcha Wora Maha Wihan Temple, and former member of the Sangha Supreme Council of Thailand, was sentenced to 36 months and fine of 27,000 baht. However, since the fifth defendant was never imprisoned before, the court granted him two years
sentence suspension.
Later, the Appeal Court’s ruling increased jail terms of the second, third, and fourth defendants, one year and six months, in addition to the Civil Court’s ruling.
Therefore, each of the second, third, and fourth defendants was sentenced to a total of four years and 24 months imprisonment.
As for the fifth defendant who is former abbot of Saket Ratcha Wora Maha Wihan Temple, his misconduct violated Section 147 and Section 86 of Criminal Code and was sentenced of one year and four months imprisonment and fine of 12,000 Baht. The Appeal Court reduced one-fourth of his sentence to 12 months imprisonment and fine of 9,000 baht.
After combined with the Civil Court’s sentence for the fifth defendant of 36 months and fine of 27,000 baht, the Appeal Court sentenced the former abbot of Saket Ratcha Wora Maha Wihan Temple a total of 48 months imprisonment and fine of 36,000 baht, with two years sentence suspension.
These are facts according to criminal law that the five defendants have received from their deeds. In conclusion, the court has not dismissed charges of the five defendants.
